Attorney Andy Strickland successfully challenged a ban on outdoor smoking in Gulfport, Florida that he believed to be illegal and unconstitutional.
In November 2011, Gulfport city council passed a ban on smoking at Gulfport Beach. The following year, Andy Strickland organized two peaceful protests, called “smoke-ins”, the second of which resulted in a citation, and subsequently brought suit against the city.
The local ordinance was amended by collaboration between Mr. Strickland and city officials and Mr. Strickland dropped the lawsuit
In February 2013, the city council voted unanimously to overturn the ordinance in response to a recent ruling out of Sarasota on a similar ordinance.
